KirbySOS values your privacy and the integrity of personal health information collected via our services. KirbySOS maintains full compliance with HIPAA and will not share your personal health information with third parties without your and/or your assigned caregiver’s consent. This privacy policy covers the collection and use of your personal information via the KirbySOS website and monthly subscription service.

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase KirbySOS, we collect personal information you provide such as your name, address, and email address. As you browse our site, we automatically receive your computer’s IP address to learn about your browser and operating system. Activating KirbySOS's monthly subscription service, you consent to providing personal information, including the name of the KirbySOS user, physical and billing addresses, emergency contact information, demographic and health information, and contact information of the primary/family caregiver(s). KirbySOS may share this information with necessary parties in emergency situations. Additionally, KirbySOS captures physical activity, sleep, and location data from the wearable device to ensure the user's safety. This information is shared between the user, KirbySOS, our call center staff, required emergency services, and the assigned caregiver(s). Email marketing: With your permission, we may send you emails about our store, new products, and other updates.

SECTION 2 - CONSENT

Consent is implied when you provide personal information for a transaction, order, delivery, or subscription activation. For secondary reasons like marketing, explicit consent is sought or you are provided an opportunity to opt-out. SECTION 4 - SHOPIFY AND CRM SOFTWARE

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases, and the general Shopify application. They store your data on a secure server behind a firewall. We also use recognized CRM systems to host and evaluate customer data to improve your experience with KirbySOS.

In general, the third-party providers used by us will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

KirbySOS and Freeus will share your location with individuals you authorize, as well as first responders and call centers, in order to provide you with assistance, including showing your location in near-real time in a web portal or application. Your consent will be valid for the duration of your relationship with us unless you revoke it. You may revoke your consent by calling 877-241-2244. If you do not consent or you revoke consent, we may be unable to provide you with assistance.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If our store is acquired or merged with another company, your information may be transferred to the new owners, so that we may continue to sell products to you.
